In light of the recent hijacking to NYC, I was wondering if this model
airbus was qualified for EROPS and if not what the legality was for
making this flight. At what point does the pilots decision to fly out weigh
   FAA or IACO rules?

The flight was legal in any case. A hijacked flight is, by definition,
in a state of emergency, meaning the PIC can do whatever he wants.
